1. Purpose
These terms of use ("Terms of Use") govern access to and use of the Kwoji platform, published by Kwoji ("the Publisher"), accessible at kwoji.com and kwoji.app. By creating an account or using the Platform, you accept them without reservation.
2. The service
Kwoji is a multiplayer game platform for coworkers within an organization. It includes a game catalog, the Daily Challenge, player profiles, badges and rankings, Clubs, Kwoji Pulse, an engagement dashboard, Google Calendar scheduling with Meet, and Slack or Teams notifications. The Publisher may add, change or remove a game or feature at any time.
3. Account and access
- The account is personal. Sign-in is done without a password, via a link sent by email or through Google: you are responsible for access to your email inbox.
- Access to an organization's features requires active membership after receiving an invitation.
- The administrators of an organization manage their members: they may deactivate a profile or remove a member from their organization.
4. Rules of conduct and content
Some games let you share content visible to your coworkers: photos (Kwoji Photo), drawings and texts (Kwoji Word, Whisper, Verita), secrets (Kwoji Secret). You undertake to publish only content that is lawful, respectful and appropriate to a professional setting — never content that is discriminatory, harassing, defamatory, sexual in nature, or that infringes the rights of third parties (image rights included: do not share the photo of a person without their consent).
You remain the owner of your content and grant the Publisher the license strictly necessary for its display to other players for the time provided by the game. The Publisher and the organizers may remove any content contrary to these Terms; serious or repeated breaches may result in the suspension or deletion of the account.
5. Intellectual property
The Platform, its trademark, its games, its design and its code remain the exclusive property of the Publisher. The Terms of Use grant no right other than the personal use of the Platform in accordance with its intended purpose.
6. Availability
The Platform is provided "as is" on a reasonable-efforts basis. The Publisher endeavors to ensure continuous availability but does not guarantee it: maintenance, upgrades and incidents may interrupt it temporarily. Kwoji is an entertainment service; the Publisher cannot be held liable for indirect damages related to its use or unavailability.
7. Personal data
The processing of data is described in the Privacy Policy. You may delete your account at any time from your profile: the deletion is immediate and permanent.
8. Paid offers
Use of the Platform is free up to 10 profiles per organization. The paid tiers (all fifteen games with no match cap, Daily Challenge, Clubs and club challenges, engagement dashboard, Kwoji Pulse, Google Calendar and Meet scheduling, and Slack or Teams notifications), available regardless of the number of profiles, are governed by the Terms and Conditions of Sale.
9. Modification of the Terms of Use
The Publisher may amend these Terms of Use; the date of last update appears at the top of the page. In the event of a substantial change, users are informed through the Platform. Continued use after entry into force constitutes acceptance.
10. Governing law
These Terms of Use are subject to French law. Any dispute relating to their performance falls, failing an amicable resolution, within the jurisdiction of the competent courts under the conditions of ordinary law.
